The rule covers a defined Food Traceability List of foods, mandates recordkeeping at seven Critical Tracking Events using specific Key Data Elements, requires every entity to assign and track a Traceability Lot Code, and sets a compliance deadline of July 20, 2028.

Most compliance guides treat FSMA 204 as a paperwork problem, but it’s a data infrastructure problem. The food companies that will navigate this with the least pain are the ones that treat the Food Traceability Rule as a reason to build a real data foundation, not just add another spreadsheet to their operations. That number, 900 preventable deaths annually from six known pathogens in foods we already track commercially, is what makes the recordkeeping requirements hard to argue against on principle. The debate has always been about cost and implementation complexity, not the underlying goal.

The FDA’s own economic analysis puts the 20-year annualized cost of the rule at a primary estimate of $570 million per year at a 7% discount rate, against annualized health benefits with a primary estimate of $780 million. The math favors compliance. It also tells you something about the scale of the data infrastructure challenge, $570 million in aggregate annual costs across the industry means this isn’t a minor administrative update.

Who Must Comply with the Food Traceability Rule

The Food Traceability Rule applies to any person or entity in the United States that manufactures, processes, packs, or holds food on the Food Traceability List, with the obligation flowing to anyone who touches a covered food at a Critical Tracking Event in the supply chain.

The four covered entity types are:

  • Manufacturers and processors who transform raw FTL ingredients into finished or intermediate products
  • Packers who perform initial packing of raw agricultural commodities from the Food Traceability List
  • Holders who store or warehouse covered foods at any point in the supply chain
  • Distributors and retailers who ship or receive FTL foods and must record those transactions

The rule reaches from the farm through distribution. A small regional produce distributor handling covered leafy greens has the same core obligation as a national food manufacturer processing nut butters. The scale of implementation differs. The legal requirement does not.

Exemptions and Partial Exemptions

Several categories of entities receive full or partial exemptions from the Food Traceability Rule. Retail food establishments and restaurants that prepare and sell food directly to consumers are exempt for the foods they serve in that context. Very small businesses meeting specific revenue thresholds may qualify for modified requirements. Farms that sell directly to consumers or to restaurants and retailers within the same state or within 275 miles also receive a partial exemption.

The FDA also built in a waiver process allowing any entity to petition for an exemption based on unique circumstances. Exemptions do not eliminate good data practices. If your trading partners are subject to the rule, your data will be pulled into their compliance chain regardless of your own status.

The companies with the clearest path to July 2028 are those already running modern ERP systems with robust lot tracking, standardized GS1 barcodes, and EDI connections to their trading partners.

The Food Traceability List: Which Foods Are Covered

The Food Traceability List is the FDA’s enumeration of high-risk foods subject to FSMA 204’s enhanced recordkeeping requirements, and it includes specific fresh produce, seafood, cheeses, shell eggs, and nut butters rather than broad food categories.

The FTL covers these major food groups:

  • Fresh produce: fresh-cut fruits and vegetables, leafy greens (including fresh herbs), tomatoes, peppers, cucumbers, melons, tropical tree fruits, and sprouts
  • Seafood: fresh and frozen finfish, smoked finfish, crustaceans (shrimp, crab, lobster), and bivalve molluscan shellfish (oysters, clams, mussels, scallops)
  • Cheeses: soft cheeses and shell eggs
  • Nut butters: peanut butter and tree nut butters

The FTL distinction matters because it determines your compliance scope. A food manufacturer producing both FTL-covered nut butters and non-covered candy bars only needs to apply the full traceability recordkeeping apparatus to the nut butter line. Getting that boundary wrong in either direction creates unnecessary cost or unaddressed compliance gaps.

Certain forms of FTL foods are excluded. Cooked, shelf-stable, or commercially sterile versions of covered foods often fall outside the Food Traceability List. A cooked, shelf-stable shrimp product in a sealed pouch generally does not carry the same FSMA 204 obligations as fresh or frozen shrimp. The 7 Critical Tracking Events Explained

1. Harvesting:

The point at which a raw agricultural commodity covered by the FTL is harvested from the growing environment. Applies to farms and growing operations.

3. Initial Packing:

The Shipping and Receiving CTEs are the two most universally applicable. Every distributor, retailer, and food service operator that touches FTL foods will generate Shipping and Receiving CTE records constantly. The Harvesting, Cooling, and Initial Packing CTEs are farm and packinghouse territory. The Transformation CTE is the one that catches manufacturers off guard, because it requires issuing a new TLC and linking it back to the input TLCs from the previous supply chain step.

How CTEs Chain Together

Key Data Elements: What You Must Record at Each CTE

The KDEs common to most CTEs include:

  • The Traceability Lot Code for the food
  • The quantity and unit of measure of the food
  • A product description sufficient to identify the food and its form
  • The location identifier for the entity performing the CTE (a facility name and physical address, or a standardized identifier like a GS1 GLN)
  • A reference document number and document type (such as a bill of lading, purchase order, or manifest number)
  • Date and time of the CTE

The Harvesting CTE requires additional KDEs specific to farm operations. These include the location description of the field or growing area (with geographic coordinates or a farm map reference), the commodity type, and the date of harvest. For the Initial Packing CTE, the packer must record the TLC they assign, the commodity, the location of the packing facility, and reference documents linking back to the harvest event.

The Transformation CTE requires capturing both the new TLC assigned to the output product and the input TLCs from all incoming FTL ingredients. That linkage is what makes the transformation record useful. Without it, the chain breaks and traceability stops at the point of transformation.

The 24-Hour Records Request Requirement

When the FDA sends a records request under FSMA 204, covered entities must provide the relevant traceability records within 24 hours. The FDA can also request records in an electronic sortable spreadsheet format, meaning entities cannot satisfy the requirement by handing over a binder of paper invoices.

That 24-hour clock is the single most operationally disruptive element for companies still running traceability on paper or disconnected spreadsheets. If your records live in three different systems or four people’s email inboxes, you cannot meet a 24-hour electronic production requirement reliably. Traceability Lot Codes: Assignment Rules and Requirements

The Traceability Lot Code is the unique alphanumeric identifier assigned to a specific quantity of an FTL food at a defined point in the supply chain, and it is the foundational element that makes the entire FSMA 204 recordkeeping system work as a connected chain rather than a series of isolated records.

Assignment rules for the TLC depend on where in the supply chain the food is:

  • At Initial Packing, the packer assigns the first TLC for produce and most other FTL foods.
  • At First Land-Based Receiving for seafood, the receiving facility assigns the TLC.
  • At Transformation, the processor assigns a new TLC to the output product and links it to all input TLCs.

The traceability lot code does not have a mandated format. It can be numeric, alphanumeric, a GS1 lot number, or any other identifier the assigning entity chooses, provided it uniquely identifies the specific lot and the entity that assigned it. Most food companies operating in retail supply chains are already using GS1 lot numbers, which meet the TLC requirement and align with retailer EDI requirements.

One important clarification: the TLC is not the same as a UPC barcode or a product SKU. Those identifiers describe what the product is. The TLC describes which specific lot it came from. A single SKU can have thousands of different TLCs over a year of production.

TLCs and Retailer Requirements

Major retailers are already extending FSMA 204 TLC requirements into their supplier agreements. Walmart and Sam’s Club require all food and beverage suppliers to submit an Advanced Shipment Notification containing FSMA 204 KDEs for all shipments, with SSCC-18 pallet barcodes linked to the ASN and GS1-128 case barcodes. Suppliers who wait for the July 2028 regulatory deadline to build TLC capabilities will find themselves locked out of major retail channels well before that date.

How to Build a FSMA 204 Traceability Plan

A FSMA 204 traceability plan is a written document that describes how your operation identifies FTL foods, assigns Traceability Lot Codes, captures Key Data Elements at each Critical Tracking Event, and maintains records that can be produced to the FDA within 24 hours in electronic sortable format.

The traceability plan must include these components:

  • A description of your recordkeeping procedures for each CTE relevant to your operation, including the systems, formats, and responsible parties for each record type.

Two and a half years sounds generous. It isn’t, for companies that haven’t started. Building traceability recordkeeping systems that reliably capture KDEs at every CTE, assign and track TLCs across trading partners, and produce electronic sortable records on 24-hour notice requires supply chain data integration work. That work takes time, budget, and alignment across suppliers, distributors, and customers who all have their own systems.

The companies most behind right now are mid-market food manufacturers and regional distributors who have strong operational systems but weak data connectivity between them. Their ERP knows what shipped. Their WMS knows what received. Neither system automatically produces an FSMA 204-compliant KDE record with a linked TLC. Closing that gap is a data integration project, not a compliance form.

What the Timeline Actually Requires

Working backward from July 20, 2028, a realistic implementation timeline for a mid-market food company looks like this:

  • Now through Q4 2026: complete the FTL food inventory, map CTEs to current operations, assess data gaps in existing systems.
  • Q1 through Q4 2027: implement or configure traceability data systems, establish TLC assignment procedures, begin trading partner data alignment.
  • H1 2028: validate records production capability, conduct a mock FDA records request drill, finalize and distribute the traceability plan.

Exemptions from the Food Traceability Rule

The Food Traceability Rule includes both full exemptions that remove entities entirely from FSMA 204 obligations and partial exemptions that reduce but do not eliminate requirements for specific entity types or transaction types.

Full exemptions apply to restaurants and retail food establishments for foods they prepare and serve directly to consumers, farms operating below specific size thresholds for direct-to-consumer and limited-area sales, and fishing vessels and other entities covered separately under the FDA’s seafood HACCP regulation.

Partial exemptions reduce the KDE and recordkeeping burden but do not eliminate it. Very small businesses, defined by revenue thresholds set in the rule, qualify for a streamlined set of requirements. Entities that receive FTL foods from an exempt supplier are still required to maintain records of their own CTEs even when the upstream records are incomplete.

The exemption structure matters for supply chain design. If your key supplier qualifies for a partial exemption, their records will have gaps. Your downstream receiving records need to be clean enough to stand on their own. Don’t design your traceability plan assuming upstream data will always be complete.
